His detailed authoritative treatise “Law of Business Process Outsourcing” is still the authoritative book on all legal issues pertaining to BPO law in India and Asia. He has been providing his perspectives and inputs of how the industry can best legally protect itself apart from providing value to overseas clients. He has been constantly encouraging stake holders in the BPO space to take appropriate safeguards for protecting the data of overseas clients. He has been arguing on the need for change in mind sets, as far as foreign clients are concerned. Earlier, foreign companies only used to make their BPO contracts subject to the relevant national laws. He has been encouraging companies to make their BPO contracts being governed both by the relevant national laws as well as by the Indian laws. He has actively encouraged foreign companies to take the benefit of various statutory remedies that are provided under the Indian Information Technology Act 2000 as also various rules, regulations, notifications and directions issues thereunder. He has handled various litigations in the BPO sector. He was the counsel for the plaintiff in India’s first case of Business Process Outsourcing industry. He represented a foreign entity, who sued a Call Centre in India for non-performance of its service level obligations and for failing to provide its quality services, despite specifically being agreed, to that effect in the BPO agreement. He was successful in getting the first BPO orders the Delhi High Court including orders of injunction. Pavan has also been actively associated with various legal issues specifically relevant in the context of Legal Process Outsourcing or LPO. He has been advising various LPO companies and players regarding their respective legal issues. He was also the counsel for the plaintiff in India's first case pertaining to the Legal Process Outsourcing industry. In this case, the plaintiff’s employee had left his employment while taking away the confidential data of the plaintiff. Pavan Duggal, as the plaintiff’s counsel in the LPO case, got the landmark order pertaining to non-disclosure of confidential trade information, secrets and data in the context of Legal Process Outsourcing in India. The case , handled by Pavan Duggal, has indeed become a landmark and has since been followed. He is advising a variety of value added Information Technology enabled service providers on how their new offerings can be in compliance with the requirements of both the local laws as also the relevant target national jurisdictions.
